1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of StreamLupe Desktop software ("Software"). This software is developed and maintained by an individual developer, not a company.
BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE.
2. Software Description
StreamLupe Desktop is a comprehensive Apache Kafka® client management and monitoring application that provides:
- • Visual interface for Kafka cluster management
- • Topic administration and real-time monitoring
- • Message production, consumption, and streaming capabilities
- • SQL-like querying engine
- • Local Kafka cluster installation and management
- • Schema Registry integration
- • SSL/SASL authentication support
- • Cross-platform native desktop application
3. License Models
3.1 Free License
The Free License grants you a non-exclusive, non-transferable, revocable right to install and use the Software on an unlimited number of computers for personal or commercial use. The Free License includes core Kafka management features with limitations on connections, topics, message history, and streaming duration. Advanced features such as SSL/SASL authentication, Schema Registry, bulk operations, and advanced analytics are not included.
THE FREE LICENSE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. YOU ASSUME ALL RISK ASSOCIATED WITH THE USE OF THE FREE LICENSE.
3.2 Pro Subscription License
The Pro Subscription License provides unlimited access to all Software features including unlimited connections, topics, and message history. It includes SSL/SASL authentication, Schema Registry integration, bulk operations, advanced SQL queries, export capabilities, and priority email support with 24-hour response time.
Subscription Terms
- • Available as monthly or annual subscription
- • Subscriptions automatically renew unless canceled before renewal
- • You may cancel at any time; cancellation takes effect at end of billing period
- • No refunds for partial subscription periods
- • Upon cancellation, license reverts to Free License with limitations
- • Maximum 2 simultaneous computer activations
3.3 Pro Perpetual License
The Pro Perpetual License provides the same unlimited access to all Software features as the Pro Subscription, including unlimited connections, topics, SSL/SASL authentication, Schema Registry, bulk operations, advanced SQL queries, and export capabilities. This is a lifetime license with no recurring fees.
Perpetual License Terms
- • One-time purchase with perpetual right to use the purchased version
- • No recurring subscription fees
- • No expiration date for the licensed version
- • Includes all updates and support for 12 months
- • Optional annual update subscription available after initial period
- • Fully offline operation after initial activation
- • License may be transferred to new hardware once per year
- • Maximum 2 simultaneous computer activations
4. License Restrictions
You agree NOT to:
Copying and Distribution:
- • Copy or distribute the Software except for backup purposes
- • Sublicense, lease, rent, or transfer to third parties
- • Make available over a network for multi-device use (except as permitted)
Modification and Reverse Engineering:
- • Modify, adapt, or create derivative works
- • Reverse engineer, decompile, or disassemble the Software
- • Remove or alter proprietary rights notices
License Circumvention:
- • Bypass license validation or activation measures
- • Share Pro license credentials with others
- • Create multiple Free accounts to circumvent limitations
Unlawful Use:
- • Use the Software for unlawful purposes
- • Access unauthorized Kafka clusters or data
- • Compromise security or engage in data theft

- • 30-day offline grace period

- • Hardware transfer: once/year
6. Intellectual Property Rights
Ownership
The Software is licensed, not sold. All rights, title, and interest in the Software remain with the developer, including all intellectual property rights. The Software is protected by copyright laws and international treaties.

- • Apache Kafka® Apache Kafka® is a registered trademark of the Apache Software Foundation
- • This Software is not affiliated with, endorsed by, or sponsored by the Apache Software Foundation
Third-Party Components
The Software incorporates third-party open-source components licensed under Apache License 2.0 and other open-source licenses. See NOTICES.txt file for complete list.
7. Warranty and Disclaimer
Free License
THE FREE LICENSE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. This includes no warranties of merchantability, fitness for a particular purpose, non-infringement, or freedom from errors or viruses.
Pro License Limited Warranty (90 Days)
The Software will substantially conform to documentation for 90 days from delivery. If it doesn't, you may request repair, replacement, or refund at the developer's discretion.
Exclusions: Warranty does not cover misuse, unauthorized modifications, unsupported hardware/software, connectivity issues, or Kafka cluster problems.
8. Limitation of Liability
Maximum Liability: Total liability shall not exceed the amount you paid for the license in the 12 months preceding any claim.
Excluded Damages:
- • Loss of profits, revenue, or business opportunities
- • Loss or corruption of data
- • Cost of substitute goods or services
- • Indirect, incidental, consequential, or punitive damages
- • Unauthorized access to Kafka clusters or data
- • Network connectivity or internet interruptions
Exceptions: Death/personal injury from negligence, fraud, gross negligence, or violations of IP rights.

Support Exclusions
Support does NOT include:
- • Kafka cluster setup or administration
- • Third-party Kafka services troubleshooting
- • Network or infrastructure issues
- • Custom development or consulting
- • On-site or phone support
10. Automatic Updates
Update Mechanism
- • Software checks for updates periodically (typically weekly)
- • Background checks when internet connection is available
- • You will be notified when updates are available
- • You may enable/disable automatic updates in Settings
- • Critical security updates may be applied automatically
Free License Updates
Included:
- • Bug fixes
- • Security patches
- • Performance improvements
- • Compatibility updates
Some new features may be Pro-only
Pro Subscription
Included:
- • All updates
- • All enhancements
- • All new features

11. Termination
Termination by You
Free License:
Stop using anytime by uninstalling. No notice required.
Pro Subscription:
Cancel anytime via account settings. Takes effect at end of billing period. License reverts to Free.
Pro Perpetual:
Uninstall anytime. License remains valid for future reactivation. Non-refundable after activation.
Termination by Developer
Your license may be terminated immediately if you:
- • Breach material terms
- • Use for unlawful purposes
- • Circumvent license restrictions
- • Reverse engineer the Software
- • Share Pro credentials
- • Engage in fraudulent activity
7 days to cure if possible, except for serious breaches (immediate termination)
Effect of Termination
Upon termination, you must:
- • Immediately cease all use of the Software
- • Uninstall from all computers
- • Delete all copies in your possession
Local data on your computer remains yours. Consider exporting connection profiles before termination.
12. Export Compliance
The Software may be subject to export control laws and regulations of the United States and other countries, including the U.S. Export Administration Regulations (EAR).
You agree that you will NOT:
- • Export or re-export the Software to any prohibited country, entity, or person
- • Use the Software in violation of export control laws
- • Allow access by persons on export control lists
You represent that you are not located in, under control of, or a national of any embargoed country or on any government prohibited parties list.
13. General Provisions
Entire Agreement
These Terms constitute the entire agreement and supersede all prior agreements. May only be modified by written amendment or revised version posted on the website.
Changes to Terms
These Terms may be modified by posting an updated version. For material changes:
- • Email notification (Pro users)
- • In-app notification
- • 30-day notice before taking effect
Continued use after effective date constitutes acceptance. You may cancel for pro-rated refund if you disagree (Pro Subscription only).
Severability & Waiver
If any provision is invalid, it will be modified to minimum extent necessary or severed. Remaining provisions remain in effect. Failure to enforce any provision does not constitute a waiver.
Assignment
You may not assign these Terms without written consent. The developer may assign these Terms freely, including in connection with sale or transfer of the software.
Force Majeure
No liability for failures due to causes beyond reasonable control: acts of God, natural disasters, epidemics, war, government actions, cyber attacks, ISP failures, or power outages.
14. Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by the laws of Mozambique, without regard to conflict of law principles. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
Dispute Resolution Process
Before formal legal proceedings:
- 1. Direct Negotiation (30 days): Send written notice describing dispute and proposed resolution
- 2. Optional Mediation (30 days): Non-binding mediation with mutually agreed mediator
- 3. Arbitration or Litigation: Proceed to binding resolution
Individual Disputes Only
Any disputes will be handled on an individual basis only. Class actions, consolidated actions, or representative actions are not permitted.
Time Limitation on Claims
Any claim must be filed within one (1) year after the claim arose, or be forever barred (except where prohibited by law).

BY INSTALLING, ACCESSING, OR USING THE SOFTWARE, YOU ACKNOWLEDGE THAT:
- 1. You have read and understood these Terms
- 2. You agree to be bound by these Terms
- 3. You have the legal capacity to enter into these Terms
- 4. If accepting for an organization, you have authority to bind it
- 5. You understand the limitations and restrictions of your license type
- 6. You understand and accept the warranty disclaimers and liability limitations
If you do not agree to these Terms, do not install or use the Software.
